Every reference to “we” or “us” in these terms and conditions and website is a reference applied to Lies Mertens NV.
Current terms and conditions are exclusively applied to consumers within the meaning of the Belgian code of economical rights (every natural person who is acting for purposes which are outside his trade, business or profession. If you’re not a consumer, our B2B Terms & Conditions are automatically applied to you. Current terms and conditions are applicable to each consumer using this website and each order the consumer places on this website or through email.
These terms and conditions can be edited from time to time, in accordance with article 17.1. The latest version is always available on our website.
“Customer” or “you” or “your”: every consumer using this website and/or placing an order throughout the website, e-mail or phone.
We try to show our products as much as possible in accordance with reality. However, an exact display is not always possible. Actualcolourscan slightly differ from website images and dimensions can be distorted. Actual dimensions are incorporated in the product specifications. Small deviations of the incorporated specifications are always possible and can’t be viewed as a non-compliant delivery. In the case you’re not satisfied, you can send your product back in accordance with article 8, “revocation right”.
Our product range can be altered at all times. We can’t guarantee certain products will always be available. Would you like to purchase a model orcolourthat is out of stock? Contact us via email and we’ll check whether this product can be ordered.
YOUR ONLINE ORDER
To order a product via our website, click “add to cart”. Before placing your order, you can check the content of your shopping cart and change your order as you wish. To complete your order, click “checkout”. Next, add your personal information and choose your desired delivery and payment method.
By clicking “completeorder”, you place a final order and agree to our payment obligations.
After placing your order, a confirmation will be displayed on screen. Within a reasonable term, you’ll also receive a confirmation email. Only when this email is sent, we have accepted your order.
In case we can’t deliver your product or can’t deliver it on time, for instance because it isn’t in stock, we will inform you about this via email within seven (7) days after placing the order. In this case, you have the right to cancel your order or choose to continue the process, keeping the expected delay into account and only if it is possible to restock the product. If you choose to continue with your order, we’ll keep you informed about the expected delivery term as soon as possible. If we can’t follow through on that payment term, you still have the right to cancel your order.
When you complete a purchase on our webshop, you can use the following payment methods: Paypal, Mastercard, Visa & Maestro.
We strive to make your payment process run as smoothly as possible. However, we’re not responsible for (temporary) problems or bad-functioning payment methods. Contact us if you experience any problems.
PRICE & PAYMENT
Displayed prices include VAT and exclude shipping costs. If you’re charged with shipping costs, this will be specified before confirming your order. This way, you won’t have to deal with unexpected extra costs.
Prices on the website can be changed at all times. Once you place an order, we won’t change the price, unless there’s a clear mistake.
It’s still possible that, despite our efforts, there is a mistake in the prices displayed on our website. When prices are clearly wrong and you’re able to assess this oversight, we’re not obliged to deliver your purchase at this pricing. When we’ve noticed this error, we’ll inform you about it as soon as possible. In this case, you will be able to cancel the order or accept the actual price. The order will be postponed until we receive your instructions. If we’re not able to reach you using the contact information you provided, the order will be cancelled after ten (10) days following our first attempt.
It’s possible to cancel your order within 48 hours of your order placement, as long as it’s not shipped yet. Contact us as soon as possible, at the latest 48 hours after your purchase order. We will get back to you as fast as we can
When your order is already shipped, it’s not possible to cancel it any longer. In that case, you can make us of your revocation right as described in article 10.
If your order is cancelled correctly and timely, we’ll send you a confirmation email. The amount paid will be reimbursed forthwith.
Purchases will be delivered at the address you passed on during your order.
When ordering several products at the same time, it’s possible the delivery will take place in different parts, depending on the availability of the goods. The term for revocation, as described in article 10, will start as soon as you’ve received the last product of your order.
The indicated delivery terms are estimated and isn’t a certain liability on our side. When a product is out of stock, we’ll inform you and you’ll have the rights described in article 4.4.
We’re not obliged to send the products as long as we haven’t received your payment. In the absence of payment fourteen (14) days after your order, the order will be cancelled.
Check your products for any damage, immediately after delivery.
ERRORS OR DAMAGED GOODS
If you’ve received the wrong product or notice any damage, you need to inform us about it immediately.
If the mistake is on our side, you can send the product back within fourteen (14) days of informing us about it, in the way described in article 11, “Returns”.
We’re offering you a choice between reimbursement or an exchange for another product we have in stock. If the product is no longer in stock, you can choose another product with the same value or a reimbursement. If possible, we can also offer to repair your purchase. For this option, we’ll inform you whether this is possible.
When placing an order on this website, you’ll have fourteen (14) days to return the received products without any reason, provided that they’re intact and unused.
To return a product, you need to inform us between fourteen (14) days at the latest about your decision. Preferably, you select the return option in your account. Otherwise, it’s possible to send us a letter or email using the contact details above. You can use the Sample form for revocation. Next, you will send us the product you’d like to return as soon as possible, within fourteen (14) days at te latest, in the way described in Article 11, “Returns”.
When returning an order, we will reimburse all payments regarding the specific product you’re returning, including shipping costs (except costs due to another delivery method than proposed by us as the cheapest standard delivery). We will pay you back using the same payment method of the original transaction, unless you’ve explicitly agreed to another payment method. In any case, we won’t charge any extra costs for the reimbursement.
In case of returning an order, you should only have opened the package as much as necessary to assess possible damage and to decide whether you wish to keep the product. Safety tags, stickers and (pricing) labels can’t be removed. All delivered supplies need to be returned as well. We reserve the right to refuse your return if these conditions aren’t met.
Returning an order is free provided that you send the package with BPost and use the return sticker delivered with the order. The sticker needs to be applied on the original packaging.
If you use any other method to return the product, you are responsible to pay the according costs.
It’s also possible to return the product in our flagship store. In that case, we’ll provide you with a delivery receipt.
Don’t forget to clearly state your contact details when returning a product. Choose your return method with care and always ask for a delivery receipt. We are not responsible for loss or damaging of the products before we take it into delivery.
